File For Divorce In Lincoln County Washington

Filing for divorce in Lincoln County, WA


Washington's Lincoln County provides cheaper and quicker divorces than many other counties in the state. Lincoln County lets couples finalize their divorce via mail without having to step foot in a courtroom. So if a couple who lives in Seattle, for example, wants to save time and money, they can mail their divorce paperwork to Lincoln County to have a judge there make their divorce official.


Instructions


1. Verify that at least one of the parties meets the residency requirements to get a divorce in Lincoln County, Washington. Washington state divorce residency requirements are governed by Revised Code of Washington (RCW) - Title 26 - Chapters: 26.09.010, 26.09.030. According to the RCW, to meet residency requirements for a divorce anywhere in Washington state, one of the parties involved must meet one of the following: (1) Is a resident of this state, or (2) Is a member of the armed forces and is stationed in this state, or (3) Is married to a party who is a resident of this state or who is a member of the armed forces and is stationed in this state.


2. Communicate with the other party to guarantee that he or she will not contest the divorce and is willing complete the divorce process without lawyers. To get a divorce in Lincoln County via their mail option, both parties must be in agreement on the divorce and must be in final agreement on the divorce paperwork mailed to the Lincoln County clerk's office.


3. Assemble and fill out the necessary documents to begin the divorce process (see link in Resources for documents). The necessary documents will be different for each couple depending on whether children are involved, financial assets and debts that need to be divided, and other situations. The two documents that you will need to gather no matter what are the Petition for Dissolution of Marriage and Decree of Dissolution of Marriage.


4. Call the Lincoln County clerk's office at 509-725-1401 to find out the current charge to file a divorce in Lincoln County. You can also call the clerk's office if you have questions on the necessary documents you'll need for your divorce.


5. Work with the other party involved to have each document signed and notarized by a notary public. Both parties do not need to sign and have the documents notarized at the same time, but each document must be signed by each party and notarized before being sent to the Lincoln County courthouse.


6. Make copies of each signed/notarized document for each party to keep for their personal records.


7. Mail all original signed and notarized documents with proper payment to the Lincoln County clerk's office. The address is:

8. Call the Lincoln County clerk's office at least one week after mailing the divorce paperwork to find out the date the divorce will be finalized. Washington requires a 90-day wait from the date the divorce petition is filed until a judge can make finalize the divorce.
